Body Of Teen Who Disappeared Seven Years Ago Found Stuck In Chimney

Human remains found inside a Colorado cabin's chimney have been identified as a local teen who went missing seven years ago, authorities said.

It appears that Joshua Vernon Maddux, 18, died accidentally, the Associated Press reported. He was identified with dental records after his body was found last month by contractors tearing down the cabin in Woodland Park, Colorado, which had been abandoned for about a decade.

The 6 foot tall, 150-pound teen was last seen in May 2008 at his home, about a mile away from the cabin. He went for a walk and was never seen again, his family said. A missing person report noted that his brother had died the year before.

Despite the lapse of time, however, his older sisters and other family members had held out hope that Maddux had simply left town to start a new life somewhere else, they wrote in the News of Woodland Park.

Authorities did not immediately release an official cause or time of death.

The Teller County Coroner on Tuesday said it appeared Maddux had been trying to get into the cabin by climbing through the chimney, the Gazette reported. There were no signs of trauma or foul play, officials said.

The family is raising money to cover costs of a memorial service, as well as to donate to charities that work to find missing people.

Grand Jury Indicts Sheriff Who Investigated Volunteer Deputy's Fatal Shooting Of Unarmed Man

Tulsa County, Oklahoma Sheriff Stanley Glanz will resign from office, his attorney said Wednesday, after he was indicted in connection with his investigation of a volunteer deputy's fatal shooting of an unarmed man.

The grand jury also made recommendations for improvements at the Tulsa County Sheriff's Office, which were released in a report on Wednesday. Scrutiny of the sheriff and his department came after the April 2 fatal shooting of Eric Harris, an unarmed man, by reserve deputy Robert Bates.

The grand jury was convened over the summer to investigate whether Glanz had neglected his duties and whether volunteer reserve deputies like Bates had received special treatment after making gifts to the department. After the death of Harris — who Bates said he mistakenly shot, thinking he had grabbed his Taser — questions arose about Bates' training as well as the thousands of dollars in equipment, vehicles, and cash he had given the sheriff's department, the Associated Press reported.

On Wednesday, the grand jury recommended that Glanz be removed immediately and a hearing on their findings be set for November, the Tulsa World reported. The grand jury also indicted Glanz on two misdemeanors: failing to release a 2009 report related to Bates and being reimbursed financially for driving a personal vehicle.

Glanz released a statement to the Tulsa World:

I know that my decisions have caused some to criticize me both publicly and privately. As sheriff, I take responsibility for all decisions made by me or in my name, but I assure you they were all made in good faith.

"I truly regret that any of my actions have led to the impaneling of this grand jury and the disruptions in the lives of the jurors and the witnesses.

In its recommendations for the department, the grand jury focused on better management of training records. The panel also recommended the department make its internal affairs investigations more autonomous, and provide an anonymous, documented way for employees to make complaints.

The shooting of Harris remains under investigation by the state. Bates has pleaded not guilty to manslaughter.

SoFi's Billion Dollar Funding Round Is One Of The Biggest Ever

The online lender is one of just six American startups to ever raise $1 billion in a single funding round.

One of the superstars of the online lending industry has raised $1 billion from investors, in one of the largest funding rounds ever for an American startup.

SoFi announced today that it was raising the new equity from Japanese technology conglomerate Softbank — a new investor — along with existing investors like the the hedge fund Third Point.

This comes after a $200 million round early this year that valued the company at just over $1 billion. While SoFi didn't disclose a valuation this time around, the Wall Street Journal reported in August that the Softbank investment would value the company at about $4 billion, making it the most valuable privately held online lending startup.

There has only been 19 venture capital funding rounds worth $1 billion or more, according to Pitchbook, which tracks the industry. Four of those were for Uber; just six American companies, including SoFi, have ever completed a billion-dollar round.

On Tuesday, online lender Avant said it had raised $325 million in a funding round that valued the company at $2 billion. Propser, which mostly does personal loans to people with good credit scores, was valued at $1.9 billlion in its most recent round. Lending Club, another online lender, went public in December of last year and, despite its stock sinking below its IPO price, has a market capitalization of almost $5 billion.

SoFi, which was founded in 2011, started out refinancing student loans. That can be a great business in a growing economy, as many college graduates may be considered risky borrowers by traditional metrics (they have no income, for instance, and can have very large outstanding debts), but actually have good job and income prospects. When SoFi was founded in 2011, the first loans were to graduates of elite business schools like Stanford, where its founder, former Wells Fargo trader Mike Cagney, graduated from.

SoFi also expanded into mortgages late last year and now offers mortgages in 23 states. It started offering personal loans in February, and has begun selling those loans to investors.

"We have an aspiration to change banking and create an alternative solution to allow people to check out of the banking system entirely," Cagney said, mentioning wealth management and insurance as possible areas SoFi could enter.

But that won't be happening in the public markets, for now. After the company raised $200 million and garnered a billion-dollar "unicorn" valuation, there were reports that the company was considering an initial public offering.

But like so many fast-growing startups (Cagney says SoFi has been profitable for two years), they were able to raise a massive round from a new private investor and stay insulated from the public markets.

Cagney described Softbank as a "long term, patient capital partner" that told SoFi it was able to grow even faster than the company previously thought. "Personal and mortgage loans were growing ahead of schedule and we needed incremental capital to support that growth," Cagney said.

Lending Club "went out there and raised $1 billion publicly and they have to deal with the public," Cagney said. "We could raise $1 billion from the private investor."

Father Of Student Who Killed 4 Classmates Is Found Guilty Of Gun Crimes

The father of a Washington state high school student who fatally shot four of his classmates before turning the gun on himself was found guilty Tuesday of illegally owning firearms.

Raymond Lee Fryberg is scheduled to be sentenced Jan. 11 for six counts of unlawfully possessing a firearm. He could face 10 years in federal prison.

Fryberg's attorney had said his client wasn't aware he couldn't own the guns that authorities found in his home. In October, his 15-year-old son, Jaylen, took his Beretta handgun to Marysville-Pilchuck High School and shot five of his classmates, including a former girlfriend and two of his cousins. Four of the teens died. Jaylen also killed himself.

At the time, authorities said the gun had been legally purchased. Investigators later determined that Fryberg had been prohibited by a Tulalip Tribal Court in 2002 from owning guns. The permanent order of protection had been obtained by a former girlfriend who said Fryberg had threatened and assaulted her, the FBI said.

In July, Fryberg's attorney told the Associated Press that the firearms charges were "ridiculous." The state of Washington had approved Fryberg for a concealed weapons permit in 2013 after he passed a background check, and Fryberg had never been informed that he wasn't allowed to own guns, his attorney said.

Prosecutors, however, said Fryberg was aware of the protective order — he had pleaded no contest to an alleged violation of its requirements in 2012, the Seattle Times reported.

Online Lender Avant Gets $2 Billion Valuation

The company will use the proceeds of a massive $325 million funding round to expand its business of making unsecured personal loans over the internet.

Avant, the almost three-year old year old online lender that was once known as AvantCredit, is the latest startup financial services company to be valued at over $1 billion by private investors.

The company said today it has raised $325 million in equity from investors, at a valuation of $1.975 billion. News of the round was first reported by Fortune.

Avant largely makes unsecured personal loans to people with credit ratings that are better than subprime but below superprime — a niche it says the fast-growing online lending industry has overlooked. Companies like Prosper and Lending Club, which make mainly personal loans, tend to focus on lenders with very good credit.

Prosper has been valued at $1.9 billion in its latest valuation, while SoFi, which started out refinancing student loans, has been valued at $4 billion. At just shy of $2 billion, Avant fits between the two.

Avant mostly lends to borrowers with credit scores between 580 and 720, "the 45% to 50% of consumers who are not subprime and superprime," Al Goldstein, Avant's 34-year old cofounder told BuzzFeed News.

The loans have annual rates of between 9% and 36%, and Goldstein could eventually go as low as 5% to 6%. The average loan size is $8,000, but can get as high as $35,000.

The latest round of funding includes existing investors like RRE Ventures and Tiger Global Management, along with the venture capital General Atlantic, which lead the round (General Atlantic is also an investor in BuzzFeed). Avant changed its name from AvantCredit in April.

Avant's focus on so-called near-prime borrowers puts more pressure on its underwriting software, which use over 1,000 attributes to figure out whether an applicant is likely to repay what they owe. The company also needs to pay close attention to loan servicing, which is done entirely in house rather than outsourced. Avant doesn't charge any fees on its loans and keeps about half of them on its own balance sheet, selling the rest to investors.

"We have skin in the game," said Goldstein, a former investment banker and real estate investor. "We take on the same kind of risk as our partners and marketplace participants."

Lending Club, the publicly traded online lender, sells off its loans to individual and institutional buyers, charging between 1% and 5% in origination fees.

Avant's massive funding round comes at a time when big online lenders are able to raise money at high valuations from private investors, but are losing favor in the public markets. Lending Club, which went public in late 2014, is trading at around $13.50, below its $15 IPO price, while OnDeck, which makes loans to small businesses, is trading at less than half its $20 IPO price.

"Lending Club is below its IPO price, but trades at rich valuation, it still is valued at an attractive price," Goldstein said. "We're very different, we're growing much faster, we have a very broad focus and a larger subset of consumers."

Because Avant keeps so many of its loans on its balance sheet instead of selling them off, it needs new money to grow. The company has raised over $650 million in equity and over $1 billion in debt; it has sold $1.8 billion in loans to investors.

Avant has originated $1.7 billion in loans this year, "faster than any marketplace platform," Goldstein says. Prosper has originated $4 billion in loans in nine years (although nearly all those loans were made after 2012). Goldstein says Avant is looking to originate at least $4 billion next year and says the company is cash-flow positive and will be profitable going forward.

Johanthan Krongold, a managing director at General Atlantic who will join Avant's board, said that all this growth is happening even as underwriting gets more conservative. "Despite having accelerated growth at scale, their loans and charge offs and defaults have fallen precipitously over the past few years and their underwriting has gotten more stringent and loss rates have fallen significantly."

The boom in online lending has come as the economy has grown steadily and unemployment has remained low, making it easier for borrowers to pay back their loans.

Goldstein said Avant's no-fee model, which keeps a sizable portion of loans on its books, creates more incentive to be careful in choosing who to lend to. "We're not going to originate for the sake of originations," he said. "The key to managing cycles is at some point you have to slow down, you have to manage your risk."

In Schools, Google's Laptops Will Soon Outnumber All Other Devices Combined

There will be more Google Chromebooks in American classrooms by the end of the year than all other devices combined, Google said today at a company event in San Francisco.

The figure is a striking indication of how quickly, and thoroughly, Google has come to dominate the massive education technology market. In 2012, Chromebooks made up just 1% of devices in American schools; iPads had a more than 50% market share. But by 2014, according to market research firm IDC, Chromebooks were outselling iPads in education.

About 30,000 Chromebooks have been activated every day since the beginning of the school year this September, mostly in schools, Google CEO Sundar Pichai said at the event. In schools, "by the end of this year, there will be more Chromebooks than every other device combined," Pichai said.

Chromebooks were able to overtake iPads in education because they're far cheaper — sometimes under $200 — have keyboards, and don't require additional software because they only run Google's Chrome browser.

When it began to make a push to sell its devices in schools, Google already had a strong foothold in many classrooms thanks to free apps like Google Drive and Docs. It also rolled out Google Classroom, a learning management tool that lets teachers collect assignments and give feedback using the company's cloud-based storage and word processing tools.

Google is also making a push to get its low-cost virtual reality viewing device, Google Cardboard, into classrooms. The cardboard viewers will allow students to go on simulated field trips and will be provided free to schools.

Catherine Coulson, The "Twin Peaks" Log Lady, Dies At Age 71

Catherine Coulson, known for her role as the Log Lady in Twin Peaks, died Monday of cancer at age 71, KOBI reported.

In addition to her work in David Lynch's cult series, she was active in the Oregon Shakespeare Festival for over 21 seasons. She also returned to her Log Lady roots with a cheeky turn on Psych as the Wood Woman, as well as appearing in a role on Portlandia with fellow Twin Peaks alum Kyle McLaughlin.

Coulson and her then-husband Jack Nance became friends with Lynch as he was making the 1977 film Eraserhead. Nance played the lead role, and Coulson was credited as assistant director and assistant camera. It was during the making of the movie that Lynch came up with the idea of a Log Lady, Coulson told HitFix in May.

"And then years later called me, I think it was like 12 years later, and said 'Are you ready to do the Log Girl?' And that's when I said I don't think she's really a girl anymore. So we called her the Log Lady.

And he put me in the pilot, and the rest is history."

Coulson, cradling a log, introduced viewers in 1990 to the isolated, moody town and its most infamous resident, Laura Palmer.

Though the series aired only for two seasons, it inspired countless pop culture references and its fan base grew from the release of VHS, DVDs, and its appearance on NetFlix. Showtime earlier this year announced it was working with Lynch on a revival of the show, featuring a number of the original cast members.

Last year, Coulson told Alternative Nation about connecting with a new generation of fans. Even 20 years after Twin Peaks aired, she said she still got stopped on the street.

"I have these little cards where I sign the autograph of the log, because that’s what I think people are really interested in, is the wood. So I gave them all little log cards, and they were very happy with that."

FBI To Start Collecting More Data On Police Shootings

FBI Director James Comey on Monday announced that the federal government will start collecting more data on police shootings for a new report on use of force incidents.

Historically, the FBI has collected numbers from local police departments on violent crimes and other offenses. The agency also collects data on justifiable homicides — defined as "the killing of a felon by a law enforcement officer in the line of duty" — as well as killings and assaults on law enforcement officers. But the agency could never definitely say how many people were dying at the hands of police, the circumstances of their deaths, or who they were.

In the wake of the killing of Michael Brown in Ferguson, Missouri, a Wall Street Journal analysis found hundreds of fatal police shootings were uncounted in the federal statistics. The lack of information prompted projects by news organizations, including the Guardian and the Washington Post, to provide more information about the scope of police shootings in the U.S.

In a statement Monday, Comey cited the ongoing debate on police use of force and said the FBI would seek more information from law enforcement agencies on shootings involving police and civilians. Once the FBI receives the data, he said the agency would release a special publication on use of force.

"We hope this information will become part of a balanced dialogue in communities and in the media — a dialogue that will help to dispel misperceptions, foster accountability, and promote transparency in how law enforcement personnel relate to the communities they serve," Comey said.

Comey also called for every law enforcement agency to submit its crime statistics into the National Incident-Based Reporting System, a database that includes information on the circumstances surrounding a crime. Only about a third of agencies are currently using the database, he said.

Comey also asked for patience from media and the public as the FBI works to provide more complete crime data, which he described as a "tremendous effort."

"But to continue in our current system without comprehensive data only stalls meaningful conversation and fuels empty debates, both within law enforcement and in the communities we serve," he said.

Fifth Student Dies From Injuries Sustained In Duck Boat, Charter Bus Crash

A fifth college student died Sunday from injuries sustained in a crash involving a charter bus and amphibious tour vehicle last week.

The crash involving the bus, which contained international students and staff from North Seattle College, and the Ride the Ducks tour vehicle, a truck and an SUV took place Thursday on the Aurora Bridge in Seattle. Four students were pronounced dead at the scene, and dozens of other people were taken to hospitals with injuries.

The students would have began their first quarter at the college on Monday, school officials said. They were identified as Runjie Song, a 17-year-old Chinese girl, Claudia Derschmidt, a 49-year-old Austrian woman, Privando Putradanto, an 18-year-old Indonesian man, and Mami Sato, a 36-year-old Japanese woman.

The identity of the fifth victim, a 20-year-old woman, was not immediately released, the Associated Press reported. Four people remain in serious condition at Harborview Medical Center, and 11 others are also still being treated.

Investigators from the National Transportation Safety Board remained at the scene on Sunday, and authorities said they were likely to stay there for three to five more days. Final results of their investigation, however, are not expected for a year.

"We're still in the fact-gathering phase," board member Earl Weener told reporters.

So far, a number of questions are focusing on the duck boat's left-front axle. One witness told KOMO earlier this week the duck's left-front wheel appeared to lock up before the crash, and NTSB investigators found damage on the axle as well as surrounding components.

The former military vehicle, built in 1945, was refurbished by Ride the Ducks International in 2005. In 2013, the company notified its local franchises about a potential failure point in the housing around an axle, Weener said. Ride the Ducks recommended a repair or increased monitoring. The NTSB is now investigating whether Ride the Ducks Seattle was notified and why they did not make the repair, Weener said.

"This fix was not on this particular duck," he said.

The duck boat did pass its annual inspections, including one earlier this year, a spokesperson from the Washington Utilities and Transportation Commission told the Associated Press.

Among the next steps for NTSB investigators will be continuing to interview witnesses, inspecting the vehicles, and conducting 3D imaging of the charter bus, duck boat, and Aurora Bridge.

The bridge, which comprises of six lanes without a median, has prompted safety concerns in the past, the Seattle Times reported. It's the narrowest 6-lane highway bridge in Washington state.

Massive crowds gathered on Benjamin Franklin Parkway in Philadelphia Sunday for a mass led by Pope Francis.

The service was the final stop of the pope's six-day visit to the United States. He was scheduled to return to the Vatican following the event.

More than 1.5 million people were expected at the mass, and members of the crowd lined up for hours before the 4 p.m. service for screening by the Transportation Security Administration and other authorities. Many people still appeared to be waiting in line shortly before the scheduled 4 p.m. start.

Earlier in the day, Francis spoke to prisoners at the Curran-Fromhold Correctional Facility. He also met with victims of church sex abuse and prayed with them.

week by agreeing to a clean continuing resolution funding the government into December," Compass Point analyst Isaac Boltanksy wrote in a note following news that Boehner will step down. "But it sets the stage for a broader fiscal fight encompassing the debt ceiling, government spending, and tax extender."

Chris Krueger, an analyst at Guggenheim Securities, said in a note that the possibility of a government shutdown at the beginning of October was lowered from 30% to 15%, but said that there's a higher chance of "some kind of accident that would keep Congress from raising the debt ceiling around Thanksgiving."

Krueger estimates the Treasury will hit the debt ceiling between November 15 and December 15, and that "the Tea Party will have more power and influence mapping out the House agenda and strategy." Krueger, like many Wall Street analysts who follow Washington, saw Boehner as someone who ultimately wouldn't let the government trip over its statutory spending limits. "Without Boehner, all bets are off," he wrote.

But with years of debt ceiling close calls and even a two week shutdown in October, 2013, investors and traders have assumed that eventually, everything gets hashed out and nothing too weird or awful will happen. "Markets have grown comfortable with fiscal cliffs due to the repetitive nature of the debates and the known cast of characters," Boltansky wrote.

A team of Goldman Sachs analysts wrote earlier this week that the debt limit would likely to be breached sometime in November, but that the government will have enough cash on hand to keep spending through early December. Even if the debt ceiling is eventually raised and the government doesn't, say, miss interest payments on its debt, brinksmanship can still have negative economic effects. The 2011 and 2013 debt ceiling shutdown "had discernible effects," on the economy a Congressional Research Service report said.

"The August 2011 debt limit impasse coincided with a marked decline in consumer confidence, small business optimism, and the S&P 500 stock index, and an increase in the equity market volatility index...In each case, these indicators did not return to their previous levels until several months after the debt limit was raised." The Government Accountability Office said that borrowing costs for the federal government rose slightly in 2011.

Regarding the 2013 showdown, which featured an actual government shtudown, the CRS notes that "those same indicators showed a much smaller deterioration in October 2013."

The Goldman analysts said there is some possibility that with Boehner no longer having to win over the restive House Republicans, he could now choose to bring up a vote to fund the government, as well as a debt limit extension. If he can't pass one before he leaves, however, "the prospects of a volatile debt ceiling debate this winter have increased dramatically," Boltansky wrote.

Attorney For Woman Accusing NHL Star Of Rape Withdraws From Case

A day after a news conference suggested evidence in a rape case against NHL star Patrick Kane had been mishandled, the attorney representing his accuser said he is withdrawing from the case after suspecting "some fabrications."

Thomas Eoannou called a second news conference Thursday night to say the investigation of a torn evidence bag had left him without confidence in how it came to be delivered to his office. The mother of his client had previously said she found the torn evidence bag — complete with alleged victim's name — left on her doorstep.

"I do not have confidence in that version of the events," Eoannou told reporters. "I don’t know how the bag got on the porch. I don’t have confidence in the version that was provided to me."

Eoannou on Wednesday had called for a criminal investigation after accusing authorities of tampering with evidence.

After an investigation by authorities, as well as Eoannou's office, however, the attorney said he could no longer represent the woman.

"It's my ethical obligation to withdraw," he said.

Eoannou added that investigators had confirmed the bag was a genuine evidence bag relating to the case. However, he could not say what may have been inside.

He added he did not believe this week's developments had any bearing on the credibility of the woman's original accusations against Kane.

"One has nothing to do with the other," Eoannou said.

Kane's attorney has previously said he hoped the rape kit would be part of the trial; he said it would show the hockey star is innocent.

The Eerie County District Attorney is scheduled to speak to reporters on Friday regarding the case.

Police have already said they have accounted for all evidence — including the rape kit — and it remained in its original packaging. A break in the chain of custody would be important because a medical examiner would be unable to testify with certainty that the evidence had not been tampered with or compromised.

Reality TV Paranormal Investigators Found Dead After SWAT Standoff

An estranged couple who had hunted ghosts together on reality TV were found dead Tuesday after a SWAT standoff at a Nevada apartment.

Mark and Debby Constantino specialized in electronic voice phenomena and had appeared on the Travel Channel's Ghost Adventures. Their work also was featured on other shows, as well as at paranormal conferences, and live ghost hunts.

According to KTVN, Debby Constantino's roommate called police in Sparks, Nevada, on Tuesday morning upon finding her missing from their apartment and their other roommate, who has not been identified, dead.

Police were able to track Constantino's cell phone to another apartment, where they found she was being held by her estranged husband, according to KTVN. Mark Constantino fired several shots at police as they approached, the Associated Press reported, but police did not return fire.

He told officers, "Give me 15 minutes to gather my thoughts or I'll kill her," police told the Reno Gazette-Journal.

A standoff ensued for hours before police stormed the door. Inside, they found both Constantinos dead. Mark Constantino was also considered a suspect in the death of the man at his wife's apartment, police said.

According to court records, Debby Constantino had filed for divorce on Sept. 10. She and her husband had also previously applied for restraining orders against each other.

Court records also revealed previous incidents of domestic violence. Debby Constantino was arrested in March after she was accused of cutting her husband with a kitchen knife during an argument over money, KTVN reported. In August, he reportedly kidnapped his wife and assaulted her with help from their adult daughter.

A friend of Debby's later posted on her Twitter account, asking the more than 55,000 followers to speak out against domestic violence.

Police Say Ahmed Mohamed's Homemade Clock Is Ready For Pick Up

After attorneys for the family of Ahmed Mohamed said Wednesday that they were considering legal options to retrieve the teen's homemade clock, police in Irving, Texas, responded it was available to be picked up during business hours — and had been since last week.

The 14-year-old was handcuffed at his North Texas high school and taken into custody on Sept. 8 after bringing the homemade digital clock to class. A teacher contacted authorities after fearing the clock looked like a bomb. Irving police seized the project as part of their investigation into whether Ahemd had tried to use it as a fake bomb to intimidate others.

"The follow-up investigation revealed the device apparently was a homemade experiment, and there is no evidence to support the perception he intended to create alarm," Irving police said in a statement on Sept. 16. "No charges will be filed and the case is considered closed."

Though police had closed their case, conversation was just beginning about whether the arrest was a sign of local bias against Muslims. The Mohamed family received an outpouring of support — including from President Obama and Mark Zuckerberg — as well as intense criticism.

On Wednesday, representatives for the family announced that the high school freshman and his siblings were no longer enrolled in the Irving school district — citing "religious persecution" — and would instead be homeschooled. The announcement also said that the teen's family had retained attorneys "to pursue Ahmed’s legal rights and regain his science project from the Irving Police Department."

The Irving Police Department then released its own statement in an effort to quell reports that the clock was being held hostage.

Police approved the clock to be returned to the family on Sept. 16, the day they announced the case was closed.

"A family representative was notified on Friday, Sept. 18, that the items were ready to be picked-up," police said.

To get his clock back, police said Ahmed's father or another representative could stop by the department any weekday between 6 a.m. and 4:45 p.m.

"Serial" May Cover Bowe Bergdahl's Disappearance In An Upcoming Season

After winning countless devoted, and rather obsessive, fans by exploring the murky case of Adnan Syed last year, the reporters behind the wildly popular Serial podcast may spend an upcoming season digging into something far more high-profile: the disappearance of Sgt. Bowe Bergdahl.

Sgt. Bergdahl went missing from his base under mysterious circumstances in Afghanistan’s Paktika province on June 30, 2009, and was held in captivity by a Taliban ally until the American government brokered a prisoner swap in May 2014.

However, the deal to trade Bergdahl for five senior Taliban figures was criticized by some who argued he had intentionally deserted his command.

Bergdahl has claimed he left the base to draw attention to the troubling conditions in his service unit, but in May he was charged with desertion and misbehavior before the enemy and is now due to face a military trial that could see him imprisoned for life.

As first reported by Maxim magazine on Tuesday, Serial host Sarah Koenig and one of the show's producers were spotted at Bergdahl's preliminary hearing at Fort Sam Houston in San Antonio, Texas, last week.

Bergdahl's lawyer, Eugene Fidell, told BuzzFeed News on Wednesday that a "Serial person" had interviewed him for "30 seconds" at the hearing, but he couldn't remember who the reporter was.

Two former members of Bergdahl's unit also told Maxim they had been interviewed by Serial producers.

The podcast's second season will be released this fall, with a third season to follow in spring 2016. However, Emily Condon, a spokeswoman for Serial, would not confirm if Bergdahl's story would be covered in either season.

"The Serial team hasn’t confirmed their topic for Season 2 yet," Condon told BuzzFeed News. "Over the last few months they've been reporting on a variety of stories for both Seasons 2 and 3 of Serial, along with other podcast projects."

Volkswagen CEO Resigns Amid Emissions Scandal

Volkswagen CEO Martin Winterkorn resigned Wednesday after revelations the automaker installed software in many of its diesel cars designed to cheat on emissions tests.

His resignation was announced at a press conference at VW headquarters in Wolfsburg, Germany.

The company's shares have tanked since U.S. federal environmental officials announced on Friday they had discovered a “defeat device” in 2009–2015 model Volkswagen and Audi diesel cars that uses sophisticated software to turn on full emissions controls only during official lab tests.

President Obama Declares California Wildfire A Major Disaster

President Obama on Tuesday declared the Valley fire in Northern California a major disaster, allowing federal funds to be sent to recovery efforts.

As of Tuesday, the fire in Lake County had burned 76,067 acres and was 75% contained. At least 1,910 structures had been destroyed, most of them homes, and more than 3,000 remained threatened, officials reported.

"As surveys are completed and additional data is confirmed, the number of structures destroyed may rise," the California Department of Forestry and Fire Protection said. "The Valley fire now ranks among the top three most destructive wildfires in California history."

Since the fire began earlier this month, nearly 20,000 people have been evacuated from their homes. By this week, several hundred people remained in shelters.

Three people were also killed, and four firefighters were injured. It was the third wildfire to hit Lake County in three months.

"The devastation and destruction caused by the Valley fire is extraordinary," Gov. Jerry Brown said in a letter to Obama. "Thousands have been made homeless by the fire. Thirty schools were closed and many remain closed. Major roads were damaged or destroyed."

Brown also requested a disaster declaration for the Butte fire, which has burned 70,868 acres — destroying about 900 structures — about 100 miles away in Amador and Calaveras counties. Officials have not announced a decision on that request.

Fire danger remains high in California, with high temperatures and wind gusts in the forecast. Cal Fire officials pointed to drought conditions as well as the danger of the bark beetle, which has turned millions of trees into dead and dry timber.

Officials are now asking residents to remove dead trees from the areas around their homes.

More than 10,000 firefighters remain on scene at nine wildfires across the state.

Volkwagen's Nightmare Is About To Get Worse: Here Come The Lawyers

The next punishment for the German automaker’s allegedly fraudulent approach to emissions testing? Class action lawsuits.

Volkswagen's reputation is in tatters and it faces billions of dollars in penalties, but perhaps the most terrifying phase of the nightmare is just beginning: The class-action lawyers are coming.

Law firm Hagens Berman, whose partner Steve Berman is an attorney in class-action litigation against General Motors over its faulty ignition switches, has been particularly fast out of the gate. It has already filed two complaints against Volkswagen, with the second complaint, filed yesterday, running 190 pages long, with plaintiffs from at least 20 states. The complaint brings over 70 counts against Volkswagen, citing different states' consumer protection laws, and asks for undisclosed damages including punitive damages and attorney fees.

Keller Rohrbank, another class-action firm, has filed its own complaint against Volkswagen, with 14 counts and 7 individual plaintiffs so far.

They're not the only lawyers circling in the bloodied waters. Bloomberg reports that the Justice Department is looking into Volkswagen's behavior and so is a group of U.S. Attorneys General, led by New York state Attorney General Eric Schneiderman.

The group, which is still being formed, will look at whether Volkswagen violated state consumer protection laws as well as environmental protection laws, specifically Volkswagen's claims that it was selling "Clean Diesel" cars, a source familiar with the matter said.

Even amid such a frenzy, victory is far from guaranteed for the class-action lawyers.

"It is not unusual to have class actions follow regulatory developments," said Neal Walters, an attorney at Ballard Spahr who has defended corporations in product liability cases. "As serious as the allegations may be from the regulatory perspective, the class actions will not be as easy as they look."

The reason why, Walters said, is plaintiffs will have to show that buyers specifically bought the affected models because of their (possibly illusory) environmental benefits, or that their cars suffered a serious reduction in resale value due to the emissions scandal and its fallout.

Hagens Berman is trying to do just that.

"I paid a premium for a Golf TDI because I was promised that it was 'Clean Diesel.' I was told that the emissions were better than a standard gas automobile. In addition, I was also promised high fuel economy," one buyer says in the firm's announcement of its class-action suit. "I now feel I have been defrauded by these claims."

Max Kennerly, a lawyer at Tor Hoerman who blogs about litigation, guessed that lawsuits will follow whatever tweaks Volkswagen is required to make to get its cars in compliance with emissions rules. If that affects engine performance, "the car you own is not the car you thought you bought," he said. "Whenever you sell these things, you're going to lose some value."

Resale value will be particularly closely watched. Alec Gutierrez, a senior market analyst at Kelly Blue Book, said the value of affected cars could decline 3% to 5% in the second-hand markets. For example, a 2013 Golf Sportswagen TDI with a $16,000 Kelly Blue Book value could see its price decline $500 to $800, Gutierraz said, based on the experience of past models which experienced recalls.

Eric Ibara, an senior analyst at Kelly Blue Book, said retail values don't always take a hit. In the GM ignition case, used car values and retail values didn't decline at all, and in the wake of Toyota's unintended acceleration saga, resale values went back to normal within a year.

"This incident is different from the above two cases as Volkswagen's issue is not life-threatening but rather violates the trust with the buying public," Ibara said. "Should Volkswagen resort to incentives to move these vehicles later, this could adversely impact the strong residual values these vehicles currently enjoy."

There's a bigger challenge for lawyers looking to sue VW. "It is very difficult for class lawyers to prove diminution in value," Walters said. "There are any numbers of factors that influence what you pay and what you sell it for."

One group sure to benefit from a successful suit against Volkswagen will be the lawyers themselves. In late 2012, Toyota settled a class-action suit related to its unintended acceleration scandal, paying out $1.1 billion to owners of about 16 million eligible cars. Of that payout, $227 million went to the lawyers. One Toyota owner revealed his cut of the settlement in a Wall Street Journal op-ed: a check for $20.91.
