Customers Bank Eliminates Fees From Higher One's Controversial Student Business

Pennsylvania-based Customers Bank wants to be the "anti-Higher-One."

Higher One is the financial services company that recently agreed to a settlement with federal bank regulators for improperly collecting more than $30 million in fees from students. Now, Customers Bank, headquartered in Wyomissing, is buying up Higher One's most controversial and criticized business and getting rid of the fees.

Customers Bank said Wednesday that it would offer students debit cards that could be filled up with their financial aid money and would charge no overdraft fees, PIN fees, or ATM fees in its 55,000 ATM network.

The company, which has $7.6 billion in assets and is the country's 115th largest bank, two weeks ago agreed to buy Higher One's disbursement business, which includes its fee-heavy OneAccount, for $42 million.

The Federal Reserve and Federal Deposit Insurance Corporation ordered Higher One and a bank partner to pay tens of millions of penalties and fee reimbursements for over 1 million students. Regulators slammed the company, saying it had used “deceptive marketing practices" in selling its One Account.

“During our due diligence at Higher One, we identified the regulatory and compliance risks of the high-fee based model that the company was using to make money from its student loan disbursement business,” Customers Bank chairman and chief executive Jay Sidhu said in a statement. Referring to the massive settlement, Sidhu said "With BankMobile, students can be confident this will never happen again."

The Higher One business will be part of Customers Bank's BankMobile business, which Customers describes as "America’s first absolutely no-fee, mobile, tablet and online bank."

The changes will go into effect when the deal closes next year. The BankMobile business launched in January and already has over 100,000 accounts, BankMobile's chief strategy and marketing officer Luvleen Sidhu told BuzzFeed News. With the Higher One acquisition, BankMobile will pick up 2 million new accounts and expects to add another 500,000 a year.

Higher One's fees — including out of network ATM fees and a 50-cent fee on PIN transactions — drew frequent and harsh criticism from activists and students, who said the fees were both high and, in the case of the PIN fee, almost unique among debit card providers.

The Department of Education released final rules that will go into effect next year that mandate schools offer a wider range of options for students to receive their financial aid money and require schools not to provide options with "excessive and confusing fees."

Sidhu said that because BankMobile is a bank — unlike Higher One, which had technology to disburse student aid money and then partnered with existing banks to provide services to students — they are not as dependent on account fees to make money.

BankMobile makes money from merchants when customers use their cards to buy stuff, what's known as interchange, as well as from the difference in the interest rate they charge customers for loans and the rate they provide on deposits. The bank said that it expected about $250 million in new deposits.

"We hope people will start using their debit cards more," Sidhu said. "We make money primarily through interchange income."

When Customers Bank announced its deal with Higher One earlier this month, it said that it expected $65 to $75 million of income, mostly from interchange.

In a statement, Sidhu said that "BankMobile will never charge an overdraft fee" and described the roughly $30 billion a year banks collect in overdraft fees as "outrageous."

Sidhu said that its student accountholders, like BankMobile accountholders now, won't have to pay any ATM fees if they have a monthly deposit. BankMobile will also provide a range of financial education services to its customers including podcasts, consultations, and "financial management tools" in its app.

"We have 4 years to convince them by giving them the best banking experience, we’re going to be treating them as true customers," Sidhu said.

Grand Jury Indicts Friend Of San Bernardino Shooters On Terrorism Charges

A grand jury on Wednesday indicted the 24-year-old friend of the San Bernardino gunman for allegedly conspiring to plan two previous terrorist attacks, as well as four other federal charges.

Enrique Marquez, who was once the neighbor of Sayed Rizwan Farook, was arrested Dec. 17 on suspicion of providing two assault rifles to Farook and his wife, Tashfeen Malik. The couple went on to kill 14 people at a Riverside County holiday party after allegedly pledging their allegiance to ISIS.

In the days after the attack, authorities said Marquez was cooperating with them. He was later arrested and held without bail after prosecutors said he was a flight risk and potential danger to the community.

Marquez is charged with conspiring to provide material support to terrorists, as well as two counts of making a false statement about the purchase of the rifles. He is also charged with marriage fraud and making a false statement on immigration paperwork.

According to prosecutors, Marquez and Farook plotted in 2011 and 2012 to bomb and shoot up Riverside Community College and a section of the busy 91 Freeway.

"This indictment demonstrates that we will hold accountable all individuals who collaborate with terrorists in executing their plans,” U.S. Attorney Eileen M. Decker said in a statement. "Defendant Marquez’s extensive plotting with Syed Rizwan Farook in 2011 and 2012, and his purchase of explosive powder and two firearms, provided the foundation for the murders that occurred this month."

Marquez is also accused of entering into a sham marriage with the sister of Farook's sister-in-law, accepting $200 a month to say they were married and help her immigration status, when she was actually living with another man.

He is scheduled to be arraigned Jan. 6.

If convicted, Marquez faces up to 15 years in prison in connection with the terrorism charge, as well as 10 years each for each of the false statements and five years for marriage fraud.

"Mr. Marquez is charged for his role in a conspiracy several years ago to target innocent civilians in our own backyard with cold-blooded terror attacks, and with providing weapons to an individual whose endgame was murder," FBI Los Angeles Assistant Director David Bowdich said in a statement. "The covert nature of the defendant’s alleged actions is a stark reminder of the challenges we face in preventing attacks planned in the name of violent jihad, and underscores the critical need for those with knowledge about terror plots to come forward."

SeaWorld Sues California Regulators Over Orca Breeding Ban

Representatives of the San Diego park sued on Tuesday, saying the California Coastal Commission didn’t have the authority to limit the breeding of killer whales in captivity.

SeaWorld filed a lawsuit Tuesday seeking to reverse a ban of its orca breeding program, the Associated Press reported.

The California Coastal Commission, which regulates land use along the coast, in October banned the San Diego theme park from breeding captive orcas even as it also approved a $100 million expansion. The breeding ban was praised by animal rights activists, including PETA, who called it a victory for "long-suffering orcas."

At the time, SeaWorld officials said they cared for the orcas as family, and it would be wrong to deny their 11 whales reproduction. The park has faced increased scrutiny since the 2013 documentary Blackfish, which accused SeaWorld of mistreating its animals.

In the new lawsuit, SeaWorld claimed the commission had overstepped its authority with the ban.

"The orcas are not, in any way, part of the coastal or marine environment," their suit said. "All of SeaWorld's activities with respect to the care, breeding and transportation of orcas occur onshore in the orca pools and not in the marine environment and are specifically governed by federal law."

Since 1976, development in California's coastal zones has required a permit from the commission. Its mission includes preserving public access as well as the environment of the state's coast.

In October, the commission approved the park's plan to build a 5.2-million gallon tank and 450,000-gallon pool for the Shamu killer whale facility, demolishing part of an old facility. The expansion was granted under the condition that the new facility not house wild orcas or "utilize any genetic material from" orcas that were taken from the wild.

A spokeswoman for the commission told the AP that it stands by its October decision.

Peyton Manning Denies Report Of Performance Enhancing Drug Use

Al Jazeera reported that Manning in 2011 used human growth hormone, a claim that the NFL quarterback vehemently denied, as did the Denver Broncos and Indianapolis Colts.

An investigation by Al Jazeera released Sunday reported that NFL star Peyton Manning in 2011 used human growth hormone, a performance enhancing drug.

Titled "The Dark Side," the hourlong documentary followed former British hurdler Liam Collins as he went undercover to speak with pharmacists, doctors, and others who said they had been involved with supplying performance enhancing drugs to athletes.

Al Jazeera's report was based on a secret recording of an interview with Charlie Sly, who in 2011 worked at an anti-aging clinic that treated Manning after he broke his neck.

Sly first told Al Jazeera that Manning and his wife, Ashley, would receive IV treatments after hours at the clinic. Sly also said shipments of human growth hormone were sent to Ashley Manning, which he believed were actually used by her husband.

Sly later said that he did not know he was being recorded and his statements were false.

"I am recanting any such statements and there is no truth to any statement of mine that Al Jazeera plans to air," he said.

Manning told ESPN that he was treated at the clinic with the guidance of Colts' medical team. He said he received treatments in a hyperbaric chamber as well as receiving nutrients through IV — during business hours.

Any medication that may have been mailed to his wife was her private affair, he added.

"Nothing that's ever been sent to her or my wife has used have I ever taken," he told ESPN. "Absolutely not. I have my treatments that I do. She may have hers, and that's her business."

Speaking at a press conference on Sunday morning, Garland Police Lt. Pedro Barineau said eight people had died in his county, and 15 had been taken to hospital with various injuries.

The deaths were caused by tornado-related traffic accidents near the intersection of Interstate 30 and the Bush Turnpike, Barineau said.

"As the sun comes up we will be able to see more but walking and driving through around Garland at the moment shows it is total devastation," he said.

About 600 buildings had been damaged by the tornadoes, he said.

Families Of Chicago Police Shooting Victims Demand Justice

On Friday night, Bettie Jones was celebrating Christmas with her family in Chicago, playing the card game Spades, drinking, and enjoying her loved ones' company. Just hours later, early on Saturday morning, the 55-year-old grandmother came to her front door as Chicago police were responding to a domestic disturbance at Jones' upstairs neighbors' apartment.

She was accidentally shot dead by an officer.

Quintonio LeGrier, a 19-year-old man, was also killed. His father had called police to report his son acting erratically and wielding a baseball bat around 4:30 a.m. local time. The Northern Illinois University student charged officers with a weapon, police said Saturday, causing them to open fire.

"My son was happy," LeGrier's mother Janet Cooksey told reporters Sunday. "He was not an angry child. He was not a violent child."

Cooksey said her son's father was against her speaking to the media and had gone to see a lawyer. She chose instead to go public with her anger at the Chicago police department (CPD).

"When is the mayor [Rahm Emanuel] going to step up?" she said. "We can't get no help with the police. CPD has failed us over and over."

The fatal shootings came after weeks of intense scrutiny of the city's police. In November, a white police officer was charged with first-degree murder for the fatal shooting of 17-year-old Laquan McDonald in 2014. Chicago police are now being investigated by the Department of Justice for possible civil rights violations. Despite forcing out the police chief, Mayor Emanuel is facing calls from activists to resign.

On Sunday, police were criticized specifically for not using tasers to subdue LeGrier.

"Why you got to shoot first and ask questions later?" Bettie Jones' childhood friend Jacqueline Walker told reporters. "It's ridiculous!"

Community activist Ja'Mal Green said LeGrier would still be alive if more police were trained to use tasers.

"We should not be here today," he said. "But now that we are, we’re gong to use this story, this family, to put more pressure on the leaders to finally change the CPD culture in our neighborhoods, to finally change the way police act towards us."

He called on the officers to be prosecuted and had a simple message for Mayor Emanuel: "You failed us before, but now it’s your time to step up or step down.

Holding back tears, LeGrier's mother clutched her phone and swiped through photos of her son before the cameras. Cooksey recalled him running a marathon last year for charity, but despaired that she couldn't get the day off work to cheer him on. "I won't get a chance to have any more memories like that," she said.

"I used to watch the news daily, and I would grieve for other mothers, other family members," Cooksey said. "And today I’m grieving myself."

A Woman Was Set Ablaze And Killed In L.A. On Christmas Day

Police in Los Angeles are hunting for a man believed to have killed a woman on Christmas Day by dousing her with gasoline and setting her ablaze, possibly with a lit cigarette.

Clarence Duwell Dear, 51, is being sought by the Pomona Police Department after a 41-year-old woman was set alight on Friday around 1:45 p.m. PT.

Police were called to the area after neighbors saw the woman run from a house engulfed in flames.

After collapsing on the street, she was treated for severe burns and taken to hospital, where she died.

The woman's identity has not yet been released.

"Preliminary information suggests that the suspect and victim became involved in a heated argument that escalated to physical violence," police said in a statement.

"It appears that during a domestic dispute, the suspect chased the victim from their residence and was able to douse the victim with gasoline," police said. "The suspect then ignited the victim, possibly with a lit cigarette."

Authorities say Dear fled the scene and has not been seen since.

"Although there is no information to suggest that he was armed with a firearm at the time of the murder, he is still considered to be extremely dangerous," police said.

Am I A Robot? Because I Have No Idea What This CAPTCHA Says

You're in a desert, walking along in the sand, when all of a sudden you look down and have to solve a CAPTCHA.

The ubiquitous authentication method is meant to distinguish real live humans from bots trying to overload a form on a website. It is always annoying, but never in my experience has it been genuinely baffling. Until today.

I got eyeglasses to deal with myopia two years and since then I fear that my overall eyesight has only gotten worse. Today at work I had to authenticate myself to send a message to a company when I saw this.

Even though my initial thought was that the image showed "exe11i," I wasn't at all sure. I asked my coworkers. While they couldn't agree with each other, they all thought I was wrong.

One suggested "xevui, " while two others put forward "xevnr" and "exvur" respectively. At best, this showed we all had varying degrees of poor vision that was no match for a nasty CAPTCHA, at worst it confirmed that the majority of us were not human.

Instead we are like Rachael in Blade Runner, human-seeming androids who had been able to pass simple tests but end up revealing our artificial natures under closer examination.

We reached no definitive conclusion about the CAPTCHA, but instead were left with a nagging feeling that our apprehension of reality is deficient.

The consensus was it said "xevur" — I entered that and was rejected. A new CAPTCHA appeared, the old one disappeared forever and we'll never know what the right answer was.

For what it's worth, even my attempt at the subsequent image failed.


Finally after a third try, I passed. But that might have just been one machine taking pity on another.

Student Finance Company Higher One Hit With Tens Of Millions In Penalties

Federal regulators have hammered the once high-flying student financial services company Higher One, saying it had "omitted material facts" from customers regarding the student checking account that was once its core product.

"As a result of these material omissions, Higher One improperly collected $31 million in fees from students" over a two-year period ending in mid-2014, the Federal Deposit Insurance Corporation said today. The Federal Reserve, which also penalized the company, said that Higher One used "deceptive marketing practices."

Higher One partnered with schools to market its checking account to their students, who would sometimes be required to go through a Higher One website, with the school's logo prominently displayed, to access their financial aid dollars. Students could choose to get their money through a Higher One account, a paper check, or direct deposit into another account.

"Higher One benefitted from students directing their financial aid refunds to the OneAccount instead of an alternative bank account or paper check," the FDIC's chairman Martin J. Gruenberg said in a statement.

Once students got a OneAccount, they would be charged fees for basic transactions, like a 50-cent fee for using a PIN to make a debit card purchase, a 3.5% fee for withdrawing money from a bank teller, or high out-of-network ATM fees.

"This is a company that had built a business model on nickel-and-diming away students' financial aid refunds," said Ben Miller, a former Department of Education official who is now a senior director at the Center for American Progress. "That is not a sustainable or legitimate way to get revenue, and the size of this settlement only confirms that."

Higher One has long been a target of student and activist complaints. Critics were particularly irked by its relationship with schools, which entered into partnerships that helped the company make money from students, including many low-income recipients of federal aid programs such as Pell Grants.

"We saw the use of the [school's] logo with the student loan kickback scandal, and with student credit cards, it’s deja vu," said former Consumer Financial Protection Bureau student loan ombudsman Rohit Chopra. "Schools with the hope of raising revenue are working with companies that break the law. Many students feel that when their school endorses a financial product, it must have been vetted."

The Federal Reserve ordered that Higher One pay $24 million in restitution and a civil penalty of $2.2 million, while the FDIC imposed a $2.3 million civil penalty and said it had to split $31 million in restitution to about 900,000 customers with its bank partner WEX Bank.

Higher One said last week it was expecting to pay "approximately $70 million" to resolve investigations by regulators. It also disclosed that it had received a civil investigative demand from the Massachusetts Office of the Attorney General over debt collection practices. Last year it paid $15 million to settle a class-action lawsuit over the marketing of its checking account product, including disclosure of its fees.

The company also said last week it had hired advisory firm Raymond James "to assist in the evaluation of all strategic options" for its remaining payments business.

The company said in a statement today that the action was referring to old business practices and that it had agreed to sell the disbursement business.

Customers Bank, which has agreed to buy Higher One's disbursements business, said it would combine it with its BankMobile business — a "no-fee digital bank" — and "charge students no or low fees to use the student deposit product."

Higher One stock has tanked this year, down almost 25% to $3.22. The New Haven, Connecticut company went public in 2010 at $12 a share. As of Tuesday's closing price, the company was valued at about $156 million.

Its stock dropped as investors prepared for new Department of Education rules that will require colleges to provide a variety of options for students receiving their financial aid money, including restrictions on fees.

Its investors were also well aware of the heat the company was attracting from authorities. The regulatory actions today, which also cover a bank partner of Higher One, are not the first for the company — in 2012 the FDIC ordered it and a different bank partner to pay $11 million in restitution for violating consumer protection rules.

The FDIC's consent order said that for more than a year, "information about certain fees, features, and limitations of the OneAccount was omitted entirely or was not clear and conspicuous." On the first page of the promotional materials given to students explaining how they would receive financial aid money faster through a Higher One account, "there was no information about the fees, features, and limitations of the OneAccount," the regulator said.

Higher One CEO Marc Sheinbaum said he has "set new standards for transparency and compliance" since joining the company in 2014.

"Today, the account experience is significantly changed and an even better student experience will be unveiled in 2016," he said in a statement. "With the announcement of the sale of Higher One’s Disbursements and OneAccount businesses to Customers Bank, we’re bringing this longstanding matter to a close and look to begin a new chapter for Higher One.”

Chopra, the former student finance regulator, said the action today is a reminder for students that they are under no obligation to choose a financial product endorsed by their school.

"They should get their own bank account that they shop for and should sign up for direct deposit whenever they can," Chopra told BuzzFeed News. "No student should blindly trust the bank partner of their school."

The Number Of U.S. Teenagers Giving Birth Has Reached A Historic Low

The number of U.S. teenage girls giving birth dropped in 2014 to a historic low, continuing a massive downward trend in teenage birth rates since 1991.

Data released Wednesday from the National Center for Health Statistics showed the birth rate for teenagers aged 15-19 across all race groups dropped 9% between 2013 and 2014 to 24.2 births per 1,000 women.

Since 1991, the birth rate for that age group has plunged 61%.

Bill Albert, spokesman for the National Campaign to Prevent Teen and Unplanned Pregnancy, told BuzzFeed News that few Americans would be aware that teen pregnancy and birth rates have declined so dramatically.

"The majority of adults think it's going up, rather than going down," Albert said. "This is the greatest story never told."

Albert said many adults make generalized, negative assumptions about teenagers' behavior. But he said a combination of both contraception and abstinence teaching has shifted behavior.

He also credited the MTV shows Teen Mom and 16 and Pregnant with exposing teens to the unglamorous reality of teenage pregnancy. "Young people tell us that these shows are far more sobering than salacious," he said.

Only seven states saw the birth rate for teens aged 15-19 remain essentially unchanged between 2013 and 2014: Alaska, Hawaii, Montana, Maine, Vermont, North Dakota, and Wyoming.

However, all states have seen a big decline in the rate since 1991.

The report also found the mean age for women giving birth for the first time in 2014 rose to 26.3 years old, up from 26.0 in 2014.

Additionally, health officials found the fertility rate for women aged 15-44 rose by less than 1% in 2014 — the first increase in the rate since the recession began six years ago.

French Terror Suspect Kills Himself In Prison

A French terror suspect who decapitated his boss and took a selfie with the head committed suicide in prison Tuesday.

Yassin Salhi, 35, was awaiting trial for the June 26 attack at the Air Products factory in the town of Saint-Quentin-Fallavier in which he was said to have murdered his employer, Hervé Cornara, before cutting off the man's head and hanging it from a fence with two Muslim flags.

Prosecutors said he then snapped photographs with the head which he sent to fighters in Syria, before trying to blow up the factory by driving his car at gas cylinders.

Interior Minister Bernard Cazeneuve said at the time that Salhi had been under surveillance by authorities between 2006 and 2008 for possible radicalization.

Salhi hung himself Tuesday using his bedsheets while in solitary confinement in the Fleury-Merogis prison, south of Paris, according to Le Monde.

He had been awaiting trial on charges of “murder as part of a terrorist operation, kidnapping and imprisoning with a view to murder, willful destruction and violence,” according to the Guardian.

PETA spokeswoman Brittany Peet told BuzzFeed News the video was secretly recorded on Dec. 11 by a zoo volunteer at a training event to which she was invited.

"The jig is up on Michael Hackenberger's animal abuse," Peet said. "He was caught on video viciously whipping a young tiger as he cowered on his back in a submissive position to the point where he emptied his anal sacs."

The video has been edited to 90 seconds, but Peet said PETA has shared the entire video with the Ontario Society for the Prevention of Cruelty to Animals (OSPCA).

"We do have an open investigation into the matter," Alison Cross, OSPCA's director of marketing and communications, told BuzzFeed News. "It's too early in the investigation to share any details of the case at this time."

Hackenberger did not respond to a request for comment, but the zoo on Monday uploaded a lengthy video to YouTube in which he denied abusing the animal.

6 NATO Troops In Killed In Afghanistan Bombing

Six foreign soldiers working with the joint NATO mission in Afghanistan were killed Monday in a bombing near Bagram, in the country's east.

In a statement from the NATO Resolute Support mission, officials said the "vehicle-borne improvised explosive device" detonated around 1:30 p.m. local time.

Three NATO troops were also injured in the attack, which is now under investigation.

U.S. Army Col. Michael Lawhorn, a Resolute Support spokesperson, said the incident occurred in the vicinity of Bagram Airfield, which is the largest international base in Afghanistan.

The nationalities of those killed were not immediately released, due to a NATO policy deferring such casualty identification to the relevant national authorities.

“We’re deeply saddened by this loss,” Brig. Gen. Wilson A. Shoffner, the Resolute Support deputy chief of staff for communications, said in a statement. “On behalf of General Campbell and all of Resolute Support, our heartfelt sympathies go out to the families and friends of those affected in this tragic incident, especially during this holiday season.”

According to multiple reports, the Taliban has claimed responsibility for the attack.

Local Afghan officials told the Guardian that the attack was carried out by a suicide bomber on a motorbike. The attacker reportedly struck a joint U.S.-Afghan patrol in the village of Bajawryan.

“I heard a huge blast and turned my head,” Attaullah, a village resident, told the newspaper. “I saw a lot of smoke. I heard some alarms and vehicles, and saw helicopters landed in the rice field. They carried the bodies and injured into the helicopters."

Voters Repeal Marriage Equality Law In Slovenia

Voters in the former Yugoslavian republic of Slovenia decided in a vote ending Sunday to repeal a marriage equality law enacted by the country's parliament in March.

Around 63% of people who cast ballots in the election voted to repeal the law, according to preliminary tallies. This gave repeal voters enough ballots to make the vote binding under the country's election laws, which require at least 20% of all the nation's voters to cast ballots for repeal regardless of the margin of votes cast. That meant the repeal vote needed at least 343,104 votes; they got more than 380,000

Slovenia became the only country in Central or Eastern Europe with marriage equality after its parliament enacted a new law in March.

But opponents forced a referendum on repeal by gathering 80,000 signatures.

A number of nearby countries have passed bans on marriage equality in recent years, including neighboring Croatia, which held a referendum in 2013.

Janez Janša, a former Slovenian prime minister who leads the conservative Slovenian Democratic Party, wrote on Twitter that the result was a victory for the "voices of reason" and the country's children.

In a statement, human rights group Amnesty Slovenia criticized the result as a civil rights setback for the LGBT movement in the region.

The group said the amended law was an act of discrimination against same-sex couples. "Same-sex couples should be allowed to marry, to be able to fully enjoy human rights without discrimination, just like couples of the opposite sex," the group said.
